Bush' Cited by Green Congressional Candidate; Asks for Appeals Court to Put Her on Ballot SAN FRANCISCO -- The Court of Appeal, 1st Appellate District was asked Monday to overturn a decision by a San Francisco Superior Court judge and place Green Party congressional candidate Terry Baum on the November ballot in the 8th District -- a seat currently held by Nancy Pelosi (D). The campaign said the basis of the petition for a writ of mandate will be the Gore v. Bush Supreme Court case which set the stage for the election of George Bush in the 2000 national elections. The petition will argue, as in Gore v. Bush, that two different standards were used in counting ballots in San Francisco, making the decision to not count legitimate votes for Baum unconstitutional. San Francisco Superior Court judge Ronald E. Quidachay ruled July 28 -- after more than 4 months of delays -- that Baum could not have her name placed on the November ballot. At issue are several hundreds write-in votes for Baum that were found, and counted by the San Francisco Department of Elections. The DOE qualified Baum as the winner of the Green nomination, but then later refused to validate the disputed votes because people wrote in Baum's name but did not fill in a small arrow -- in effect, the "hanging chad." Baum, a lesbian playwright in San Francisco and a staunch anti-war and pro-civil rights activist, has built an army of campaign backers who decry Pelosi's vote for the Patriot Act and support for sending even more troops to Iraq.
